This is to inform you that your identity and contact information (name, personal or business address, and phone number) have been requested by a law firm representing Eudier Leaño (“Plaintiff”), an individual whose company, SLG, LLC previously contracted with Ryder Last Mile, Inc. (“Ryder”) to provide transportation services, who has filed a representative action lawsuit against Ryder. Plaintiff is seeking to pursue this representative action on behalf of all other drivers/owners of service partner entities that signed a Master Services Agreement with Ryder in effect in California between June 4, 2023 and the present. Plaintiff alleges that Ryder misclassified Plaintiff and his proposed representative group as independent contractors, and failed to provide them with minimum wages and overtime wages owed, failed to reimburse business expenses, made unlawful deductions from their wages, failed to keep required payroll records, and failed to provide accurate itemized wage statements. Plaintiff also brings individual claims for declaratory relief and retaliation. The lawsuit is pending in the County of Orange, Case No. 30-2024-01405201-CU-OE-CXC.
Ryder denies any liability or wrongdoing of any kind with respect to the lawsuit and contends that it did not classify Plaintiff and his proposed representative group as independent contractors, but rather that Plaintiff failed to properly employ himself under his company’s contract with Ryder and is responsible for any claimed violations. Ryder further contends that this lawsuit does not have any merit and should not proceed as a representative action. The Court has not made a determination as to whether or not the claims have any validity.
